- According to Mercer County Prosecutor’s Office spokesperson Casey DeBlasio, the prosecutor’s office downgraded the indictable charge — aggravated assault — to a disorderly persons offense.

The case has been remanded to the Princeton Municipal Court. -

Good for Cannady and the Princeton basketball team. Hopefully, Princeton's Department of Public Safety is comfortable with this decision.

Not exactly sure, but it would appear to be related to the fact that Cannady is due to appear in Princeton Municipal Court today.

That doesn't pass the sniff test. A court date will last 30 minutes (after a long wait) and is local so has no impact on his ability to play over the weekend. Something else is going on here.

Tend to agree. What about a Monday court date would keep you from playing at 8pm on a Friday and Saturday night?

I posted the update from the Daily Princetonian in the earlier Cannady thread, but I will put it here as well.

Cannady did not appear in court on Monday, but his lawyer said that he received documents from the Prosecutor's Office on Sunday and needed time to review them. The judge gave Cannady an adjournment until Monday March 4th at 1:00 pm.

If Cannady's absence this weekend was related to his trial, then it would seem that he would not play this weekend as well. We'll see what happens on Friday night.

You need time to prepare, even for a brief appearance. Preparation can include reviewing documents you have (i.e., not waiting for documents from the other side for you to review). Could also be that DC was not emotionally able to focus on games. Every lawyer knows that clients about to appear in court are frequently highly unsettled.

I don't know if either was the case here, but they are obvious possible explanations.

The adjournment is normal and just if there were last minute documents (evidence). However, if this is now a misdemeanor charge in a lower court, that should have provided a tremendous sense of relief to Cannady and his defense team.

Further, the fact that the presiding judge is a 1969 Princeton grad could help. Not only may there be alumni loyalty, but in 1969 disorderly conduct while stoned was the norm on college campuses in the northeast.

Objectively perhaps, but clients are not always able to view things objectively.

Sort of like spouses.

His attorney received additional documentation on Sunday. The games were Friday and Saturday.

Putting aside the fact that its a complete joke a punch at a police officer (interestingly employed by the same University conducting its own internal investigation) was suspiciously "downgraded" without any court proceeding or other formal proceeding, something happened prior to Friday's game that changed the story and is keeping DC out. We have no idea what it is but it is telling that he was on the bench supporting his teammates during his gratuitous suspension, and this weekend he was not in attendance (that we know of).

Not being a fan of conspiracy theories, I don't know what it's "telling" about. Did you know the judge is a Penn law grad?

it could be that his own lawyer submitted materials on game day that he didn't know about or wasn't told about in the 6 weeks before this past weekend and that caused him so much distress (even more than his finals preparation at Wawa at 3am)that he just didn't have it in him to play. That's possible. And hell may have frozen over this past weekend and no one told any of us either.

As a Penn fan I would love to join the conspiracy theorists. But a downgrade to a simple assault to a disorderly persons offense is routine. A continuation of an initial listing of a hearing is routine. I would expect a routine outcome of Pre-Trial Intervention, with maybe a fine, unsupervised probation and a dismissal of the charges after 3 to 12 months w/o further bad conduct by Canady. If I couldn't have obtained that outcome for any client with no prior offenses when I was practicing, I would have given up my spurs.

The only caveat I have is that he threw the punch at a policeman. But so far, Cannady has not received any special treatment. It has been a routine procedure.

In the most recent Road to Ivy Madness podcast, Noah Savage mentioned that the team is without the services of Cannady and he doesn't know what's going on with that situation.

The team announced today that Cannady is "taking a voluntary leave of absence from school and will not be playing basketball for the remainder of the season. He has our full support."
